The High Court in Lilongwe has overturned a lower court’s decision to extradite Shepherd and Mary Bushiri to South Africa.
Justice Mzonde Mvula ruled the committal order “lacked judicial reasoning and fairness,” setting it aside.
The court found the Magistrate failed to address key legal issues, nullifying the extradition order.
This decision is a twist in the Bushiris’ long-running legal battle with South African authorities, who seek their return on fraud and money laundering charges.
Bushiri and his wife fled South Africa to Malawi in November 2020, just a few days after the Pretoria Central Magistrate’s Court granted them R200 000 bail each as he insisted that he was not running away from any trial but wanted his native country’s intervention on his safety.
They astonished people having announced they left South Africa yet their travel documents were seized as part of their bail.
They however said they fled because of security concerns in the rainbow nation.
Earlier today, police seized their R5.5 million property because the two had not availed themselves in court.
